Welcome to Awara Banjara. These Terms and Conditions govern your relationship with Awara Banjara (OPC) Private Limited (“us”, “we”, or “our”) and outline the rules and regulations for booking and participating in our premium Himalayan travel experiences.
By booking a trip with us, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access our services or participate in our journeys.

1. Age Limit and Eligibility

  • Exclusive Age Criteria: All departures, road trips, and treks organized by Awara Banjara are exclusively curated for young adults aged between 18 to 35 years old.
  • Verification: Valid government-issued age verification IDs (such as Aadhaar, Passport, or Driving License) must be provided at the time of booking or prior to departure. We reserve the absolute right to cancel bookings without a refund if a participant does not meet this age criterion.

2. Booking, Payments, and Token Policy

  • Token Reservation: To secure a nomadic slot or seat on any of our curated itineraries, a mandatory 10% non-refundable token amount must be paid at the time of booking.
  • Balance Due Upon Arrival: The remaining 90% balance of the total tour package fee is strictly payable immediately upon your arrival at the designated starting base/hub (e.g., Manali) before the journey commences. Failure to clear the balance upon arrival will result in immediate cancellation of your slot without a refund of the token amount.

3. Mountain Adventure, Risks, and Liability

  • Inherent Risks: Traveling through high-altitude terrains such as Spiti Valley, Ladakh, and Kashmir involves inherent risks including landslide roadblocks, extreme weather disruptions, physical exhaustion, and Acute Mountain Sickness (AMS). By booking, you acknowledge and voluntarily assume all risks associated with high-altitude travel.
  • Execution & Alterations: While our execution is strictly professional and top-tier, itineraries may be altered, shortened, or rerouted dynamically on-ground due to safety concerns, road closures, or government restrictions. Awara Banjara (OPC) Private Limited shall not be held liable for additional expenses or refunds arising from such unavoidable changes.

4. Medical Fitness & Pre-existing Conditions

  • Health Disclosure: Participants must disclose any pre-existing medical conditions (such as asthma, heart issues, or severe allergies) before booking.
  • Liability of Expenses: If a participant falls severely ill due to high altitude or negligence of their health during the trip, any emergency medical, hospitalization, or evacuation expenses will be fully and strictly borne by the participant.

5. Luggage & Personal Belongings Disclaimer

  • Self-Responsibility: Awara Banjara is not responsible for the loss, theft, or damage of any personal belongings, luggage, electronic gadgets (such as professional cameras, phones, drones), or cash during the journey. Participants are strictly advised to take care of their own gear and valuables.

6. Damage to Property Policy

  • Recovery of Costs: If any participant, through negligence or intentional behavior, damages the tour vehicle, camping equipment, or property of homestays/hotels during the trip, the full cost of repair or replacement will be recovered directly from that specific participant before the conclusion of the trip.

7. Media & Photography Consent

  • Promotional Rights: By traveling with us, you acknowledge that you are part of an active travel community. Awara Banjara reserves the right to use any photographs, videos, or reels shot during the trip featuring the participants for promotional, marketing, social media, or website purposes without requiring further written consent or compensation.

8. Code of Conduct and Tribe Vibe

  • Mutual Respect: We build a “Tribe,” not just a tour group. Every participant is expected to maintain mutual respect, camaraderie, and cooperative discipline towards fellow travelers, coordinators, and local communities.
  • Zero Tolerance: Any form of harassment, discrimination, rowdy behavior, or illegal substance abuse will result in immediate expulsion from the trip without any refund or transport assistance.

9. Jurisdiction and Legal Compliance

  • Governing Law: Awara Banjara (OPC) Private Limited is a legally incorporated corporate entity registered under the Ministry of Corporate Affairs, Government of India. Any legal disputes or claims arising out of our services shall be subject strictly to the exclusive jurisdiction of the courts located in Manali, Himachal Pradesh, India.
